2025年9月1日,最高人民法院《关于审理劳动争议案件适用法律问题的解释(二)》正式施行,在无固定期限劳动合同、二次合同续签、用工主体责任、劳动合同订立规则等方面,为劳动争议案件审理提供了更为明确的司法口径 。
在当前经济环境复杂多变、人力成本持续攀升的背景下,企业面临着降本增效与合规风控的双重压力。《司法解释(二)》的实施对企业的组织优化、业务出售与人员调整等战略举措提出了更高的合规要求,意味着企业应当重新审视劳动关系在组织变革中的重要性并充分预判潜在的风险挑战。人力资源管理者更需要在合法合规的前提下,精准平衡企业成本控制与劳动争议防范,探索"法-理-情"相结合的员工关系管理新路径。

On September 1, 2025, the Supreme People's Court of China officially implemented the Interpretation (II) on Several Issues Concerning the Application of Law in the Trial of Labor Dispute Cases(hereinafter the "Interpretation II"). The new interpretation provides clearer judicial standards on key labor issues, including open-term employment contracts, renewal of fixed-term contracts, employer liability, and rules for concluding labor contracts.
In the context of a complex and evolving economic environment and rising labor costs, enterprises are facing growing pressure to reduce costs while maintaining compliance and managing risks. The introduction of Interpretation (II) sets higher compliance requirements for corporate strategies such as organizational restructuring, business divestitures, and workforce adjustments. It underscores the importance of re-evaluating labor relations in organizational transformation and anticipating potential legal and operational risks. For HR and legal professionals, this calls for a delicate balance between cost optimization and dispute prevention, underpinned by lawful, rational, and empathetic management practices — exploring a "Legality–Reasonableness–Sympathy" integrated approach to employee relations.
