Harmful Online Content & Minors: What the New Measures Mean for Corporate Compliance
在数字浪潮深刻重塑青少年成长生态的当下,网络空间已然成为未成年人学习、社交与娱乐的核心场域。然而,海量信息中潜藏的性暗示、网络暴力、不良价值观等内容,正对青少年身心健康构成不容忽视的影响与挑战。
为系统回应这一社会关切,八大部门联合出台《可能影响未成年人身心健康的网络信息分类办法》,首次以"四大类负面清单"划定了精准红线,为网络信息的识别、提示与监管提供了明确依据,也为教育机构、互联网平台及相关企业的合规运营提出了更高要求。
In the digital age, the internet has become a vital space for minors to learn, socialize, and engage in entertainment. However, amidst the vast expanse of information, content such as sexual innuendos, cyberbullying, and harmful values poses potential threats to the healthy development of young people. To create a safer online environment that supports the physical and mental well-being of minors, and to clearly define the types, scope, assessment criteria, and notification methods for online information that may affect them, eight government departments jointly issued the Measures for Classifying Online Information That May Affect the Physical and Mental Health of Minors. For the first time, this regulation establishes a "negative list" across four major categories, setting precise boundaries. The Measures provide critical guidance for defining harmful information and for the oversight responsibilities of schools, businesses, and internet platforms moving forward.

This session will provide a detailed interpretation of the Measures across seven key areas:
- Background and Legislative Significance: Exploring the complexity of the online information environment, the unique developmental characteristics of minors, and broader societal concerns to contextualize the rationale and importance of the regulation.
- Interpretation of Core Provisions: Focusing on the four categories of the negative list—information that encourages minors to imitate harmful behavior, information that negatively impacts minors' values, improper use of minors' images, and improper disclosure of minors' personal information—with illustrative examples.
- Compliance Essentials in Key Areas: Analyzing compliance obligations across three domains: educational institutions, platform companies, and commercial marketing, covering the use of minors' information, platform duties of care, and emerging issues in marketing practices involving minors' images.
- Case Studies and Legal Consequences: Reviewing real-world cases to highlight the prevalence of harmful information and the legal repercussions of non-compliance.
- Corporate Compliance Strategies and Tools: Offering practical recommendations for building internal compliance systems, leveraging technical tools to mitigate risks, and establishing emergency response mechanisms.
- Future Regulatory Trends and International Perspectives: Comparing Chinese and U.S. regulations to support multinational companies in developing a global compliance framework with jurisdiction-specific guidelines.
- Summary and Self-Assessment Checklist: Providing a hands-on checklist for participants to assess their current practices and engage in interactive self-evaluation.
