Interpretation of the Comprehensive Rectification Plan for Illicit Cross-Border Operations in Securities, Futures, and Funds

Recently, eight Chinese regulatory authorities, including the China Securities Regulatory Commission (CSRC), jointly issued the "Implementation Plan for the Comprehensive Remediation of Illegal Cross-Border Securities, Futures, and Fund Operations" (hereinafter referred to as the "Remediation Plan"). The issuance of the Remediation Plan marks that regulatory authorities have integrated illegal cross-border securities, futures, and fund operations into a multi-agency coordinated, full-chain supervisory, and normalized comprehensive governance framework.


This round of remediation represents a continuation and consolidation of prior regulatory actions. Since the end of 2022, the regulators have established a rectification approach centered on "effectively curbing new illegal activities while systematically resolving existing ones," and subsequently articulated the principle of "applying unified supervision to similar types of business activities." Building on this foundation, the Remediation Plan introduces the overarching objective of a "two-year concentrated remediation period," sets forth the fundamental principles of "resolutely cracking down on illegal operations and prudently addressing existing ones," and systematically enhances the governance mechanism.
