Join us for a conversation on the U.S. regulatory environment in the Trump era – including the policy trajectory and enforcement of the Foreign Corrupt Practices Act (FCPA) and U.S. sanctions —and the implications of those priorities for corporate compliance programs. The presentation will look toward the trajectory of policy and enforcement in white collar law in the Trump era and how firms with Chinese exposure might be impacted.

Our featured guests will be Patrick Stokes and Adam Smith. Patrick served as the Chief of DOJ’s Foreign Corrupt Practices Act Unit from 2014 to 2016 and, before that, was Co-Chief of the Securities and Financial Fraud Unit from 2010 to 2014. Adam served as the senior advisor to the Director of the U.S. Treasury’s sanctions agency and as Director for Multilateral Affairs at the White House from 2010 to 2015. Among other topics, Patrick and Adam will discuss:

  • Regulatory developments driving corporate enforcement efforts;
  • Trends in anti-corruption, securities and financial fraud, and economic sanctions enforcement;
  • U.S. agencies’ investigatory and litigation tactics;

    Adam Smith served in the Obama Administration as the Director for Multilateral Affairs on the National Security Council and as Senior Advisor to the Director of the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC), the agency that designs, implements and enforces U.S. sanctions. Adam travelled to more than 50 countries to meet with corporate and government officials to talk about sanctions, compliance, and risks. As a primary architect of the U.S. sanctions on Iran and Russia, Adam negotiated the implementation of parallel sanctions by the European Union, Canada and Australia, and designed sanctions relief strategies in the context of the Iran nuclear agreement. At Gibson Dunn, Adam has worked with some of the largest companies in the world regarding complying with sanctions, engaging regulators, and responding to government inquiries.

    Patrick recently served as the DOJ’s Chief of the FCPA Unit, where he oversaw all criminal FCPA enforcement investigations, compliance assessments, and monitorships. Patrick served as the DOJ's principal representative to the OECD's Working Group on Bribery. Before leading the FCPA Unit, Patrick served as the Co-Chief of the Securities and Financial Fraud Unit of the Fraud Section of DOJ. During Patrick’s nearly 18 years as a federal prosecutor, he tried more than 30 federal jury trials including the largest financial bank fraud case in U.S. history. Patrick began his career at the Department of Justice’s Tax Division, where he prosecuted complex corporate and individual tax fraud cases.
