Event Details

China’s antitrust regime is undergoing rapid changes, with a series of draft guidelines to supplement antitrust enforcement and a draft revision of the Anti-Unfair Competition Law (AUCL). This creates challenges for businesses both large and small. Our panelists, Su Sun of Economists Inc., Brett Gerson of the U.S. Embassy, and Victor Shen of Henkel, will provide practical advice for navigating the new regulatory environment. Refer to attached document for further details on the selected topics.

Topics include the application of the Anti-Monopoly Law (AML) to intellectual property rights; readjustment of corporate compliance programs to address evolving regulatory issues; and engagement by the US government with China. Legal Committee vice-chair Becky Koblitz from Sheppard Mullin will moderate the session.

    Commercial Policy Officer at US Embassy

    Brett D. Gerson is the Commercial Policy Officer for the Foreign Commercial Service at the US Embassy in Beijing, China. In that role, he covers a wide variety issues related to commercial rule of law and regulatory challenges that US companies face in China. Prior to his role at the US Embassy in Beijing, Gerson served as a legal advisor on China-related international trade matters at the US Department of Commerce, and he was an associate attorney in a multinational law firm’s international trade group. Gerson received his J.D. from American University, Washington College of Law and his B.A. from the University of Arizona.

    Special Counsel at Sheppard Mullin

    Becky Koblitz is Special Counsel in the Beijing office of Sheppard Mullin Richter & Hampton LLP. She was born and raised in Tokyo, and graduated from Stanford University and American University Law School in the US. Koblitz’s 30 years of legal experience spans three continents and broad areas of expertise. She began her legal career with the US Department of Justice's Antitrust Division, prosecuting retail gasoline price-fixing cases, from grand jury to trials, as well as reviewing merger filings in the energy sector. Koblitz moved on to corporate law in Berlin, Germany, where she spent much of the last decade practicing real estate, finance and corporate law. She Koblitz has returned to her “antitrust roots” in Beijing as the only former federal prosecutor resident in China, where she manages and develops the antitrust and white-collar practices for Sheppard Mullin. Her practice includes advising foreign companies on antitrust compliance as well as anti-corruption (FCPA) compliance, managing internal investigations and other measures to prevent or minimize risks. Koblitz recently authored “The Practitioner’s Guide to Antitrust in China” published by Kluwer Law International (September 2015).

    Koblitz is a member of the Washington, DC bar (1982).

    Chief Legal Counsel at Henkel

    Victor Shen is the Chief Legal Officer of Henkel Greater China & Korea as well as the Henkel Greater China Executive Committee Member. In 1996, Shen graduated from Anhui Normal University and entered Nanjing University with excellent performance, earning a Master;s Degree of International Economic Law afterwards, and was admitted to the National Judicial Exam & Law Practicing Certificate in 1998. Shen took up the positions of Legal Counsel of CMCC (Hong Kong) Zhejiang Branch, Chief Legal Counsel of Kao (Japan) China and Legal Manager of Carrefour Group (French) Dia China respectively from 1999 to 2006. In July 2006, he became the Chief Legal Officer of Henkel Greater China & Korea and much of his work focuses on dealing with the M&A & strategic projects, legal issues such as anti-trust cases, disputes settlements and compliance. Also, Shen is the Henkel Greater China Executive Committee member and performs overall management and coordination. Beyond that, many of his academic achievements have been published in journals, such as “Discussion on Systematic Management of the Defaulting Mobile Subscriber” in Post Enterprise Management in 2000 and “China’s Draft Regulation on Takeovers of Listed Companies” in Asia Law M&A Review in 2006.

    Vice President of Economists Incorporated

    Dr. Su Sun is a Vice President at Economists Incorporated, an economic consulting firm headquartered in Washington, DC. He specializes in economic analysis in antitrust and IP matters. He has conducted economic analysis in both mergers and conduct matters before the US and Chinese antitrust agencies. He has also worked on estimation of damages in a number of cartel cases in US courts, and has provided analysis in some abuse of dominance cases, including those involving bundled discounts, exclusionary practices and the licensing of patents.

    Sun has written extensively on antitrust issues, particularly those pertaining to China. His English writings have appeared in publications such as the Antitrust Law Journal, Journal of Competition Law and Economics, Journal of Antitrust Enforcement, Emerging Markets Finance and Trade, and CPI Antitrust Chronicle. He also contributed chapters to several books such as Econometrics: Legal, Practical and Technical Issues (Second Edition), Market Power Handbook: Competition Law and Economic Foundation (First Edition), Antitrust Law and Economics of Product Distribution, and Policy Reform and Chinese Markets: Progress and Challenges. He was among the main drafters who commented on several Chinese draft antitrust/IP regulations and guidelines on behalf of the American Bar Association’s Antitrust Section and International Section. His Chinese writings have appeared in several Chinese journals and magazines.

    Sun is a Senior Editor of the Antitrust Law Journal, an associate member of the ABA Antitrust Section and International Section, and a member of the American Economic Association, the Chinese Economists Society and the Licensing Executives Society.

    Sun received his Ph.D. in economics from the University of Michigan and his B.A. from Renmin University of China. While at the University of Michigan, he taught economics at both the undergraduate level and the MBA level. He has also taught antitrust economics in a summer course at Renmin University.

Attending an Event
Events have limited seating, so to ensure your attendance we encourage advance online registration and payment for ALL events. We cannot guarantee entry to anyone not registered in advance.
Most of our events are in English and off the record, but please check the webpage for each event to avoid disappointment.

Advance Tickets and Discounts
Members can receive a discount by purchasing an advance ticket at least 24 hours before the day of the event. You must pay online at the time of registering for the event to be eligible for a discount.
Discounts will not be available to members at the door.

Receipts (fapiao)
You can receive your fapiao when you arrive for an event provided that you buy an advance ticket and pay online at least 1 working day before the event and you provide the correct information for your fapiao at that time. You can leave details of the type of fapiao you need on the registration and payment page.
 
Event attendees can request a fapiao at the door or up to two months after the event. Requests made after that time will not be accommodated. Please contact the AmCham China staff member responsible for organizing your event.
 
Cancellation Policy
If you cannot attend an event for which you have registered, please cancel your registration no later than one business day prior to the event. If you fail to notify AmCham China of your cancellation in a timely fashion, you will forfeit the fee you have already paid.
