With changing economic conditions in China, foreign-invested companies are increasingly dealing with reducing their workforce or even closing operations. Human Resources must work with legal counsel to apply best practices to ensure layoffs are conducted properly and well-communicated.

When issues arise, HR departments need to be aware of how to avoid a clash. Yi Li of FESCO’s Legal Division, Lizzy Li of Pfizer, Amanda Shi of Caterpillar, and Johnny Choi of DLA Piper will all provide experiences and insights on how understanding legal regulations will bolster the work of your HR Department. Russell Leu of Sheppard Mullin and Lydia Zhou of ConocoPhillips will jointly moderate the session representing both working groups.

    Johnny Choi

    Partner at DLA Piper

    Johnny Choi is an Of Counsel in the Employment team, based in DLA Piper's Beijing office. He advises Chinese and foreign multinational clients on employment, remuneration, talent retention/competition and anti-corruption matters in China, and has been based in China for almost 10 years.

    Choi has extensive experience in all areas of employment law, including: redundancies, dismissals, HR reorganizations and transfers, employee IP infringements, post-termination restrictive covenants, expatriate secondments, privacy, workplace rules, labor unions and social security.

    He has expertise advising technology companies on defending loss of talents and know-how to local competitors. He advises financial institutions and retail companies on the design and implementation of employee compensation and incentive schemes. Choi also recently led a number of investigations into alleged corruption within multinational life science companies and airlines in China and advised on related compliance and employment issues.

    Choi has been recognized by Chambers Asia Pacific for his PRC employment expertise consistently since 2013.

    Russell Leu is a special counsel in the Corporate Practice Group, residing in the firm's Beijing office. His clients are primarily located in China and the Pacific region. Prior to joining the firm, Leu was the managing attorney and Chief Representative of the Beijing office of a major US law firm and also established his own law practice in the state of Hawaii.

    Leu has a unique practice and considerable experience handling both international, corporate and cross-border transactions related to a PRC inbound practice as well as advising clients on US corporate and real estate matters. Because he is US qualified and licensed to practice law in Hawaii and has considerable experience at handling corporate, financing and real estate matters in the US, he routinely assists outbound and international clients with their US interests. Leu is also admitted to appear in the US courts, including the Hawaii state courts and the US District Court.

    Leu's practice includes corporate, real estate, banking and finance, litigation, insolvency and real estate matters. He represents major national and local financial institutions, real estate companies and corporate clients. Leu is an active member of the Hawaii State Bar Association and served on the board of the Bankruptcy Law Section of the Hawaii State Bar Association. In addition, he authored numerous articles in the Hawaii State Bar Journal. He frequently speaks at Hawaii State Bar events relating to China outbound investment activity.

    Lizzy Li has 8 years of experience specializing in Employee Relations, from the expertise as the HR Employee Relations Lead and previously as the external Legal Counsel. Li joined Pfizer in 2011 when she led the HR Integration Project after a M&A. Now she has assumed HR Employee Relations Lead for Pfizer China and supports Asian Markets on a task basis. Before that, Li was the Employment Law Counsel for FESCO's Legal team serving dozens of prestigious companies from 2008. She graduated from Renmin University of China with a Master's degree of law in 2008.

Li has much hands-on experience regarding employee relations management, contract design, downsizing, and M&A. He has led many complicated consulting projects regarding M&A, regulation reform, downsizing, cooperate democratic management and other areas. Li has served for many years as a legal consultant for some internationally prestigious corporations.

    Legal Counsel at Caterpillar

    Amanda Shi joined Caterpillar's legal team in 2013 and has been primarily working on anti-bribery compliance and employment law matters, including workforce reduction, executive terminations, labor dispatching, expatriate immigration and other day-to-day employment law issues.

    Shi began her career in the private practice with Jingtian and Freshfields for a total of 8 years. She gained extensive experience in litigation and arbitration, mergers & acquisitions, foreign direct investment and various general corporate matters. Prior to joining Caterpillar, Shi served as China General Counsel and Regional Compliance Officer of AES, another US-based multinational company.

    Shi passed the PRC Bar Exam in 1998 and was admitted in the State of New York in 2005. She received her LLM from the University of Pennsylvania Law School, her Masters in Law from Peking University and her LL.B. from Renmin University of China. She also studied international law as an exchange student in Japan.

Attending an Event
Events have limited seating, so to ensure your attendance we encourage advance online registration and payment for ALL events. We cannot guarantee entry to anyone not registered in advance.
Most of our events are in English and off the record, but please check the webpage for each event to avoid disappointment.

Advance Tickets and Discounts
Members can receive a discount by purchasing an advance ticket at least 24 hours before the day of the event. You must pay online at the time of registering for the event to be eligible for a discount.
Discounts will not be available to members at the door.

Receipts (fapiao)
You can receive your fapiao when you arrive for an event provided that you buy an advance ticket and pay online at least 1 working day before the event and you provide the correct information for your fapiao at that time. You can leave details of the type of fapiao you need on the registration and payment page.
 
Event attendees can request a fapiao at the door or up to two months after the event. Requests made after that time will not be accommodated. Please contact the AmCham China staff member responsible for organizing your event.
 
Cancellation Policy
If you cannot attend an event for which you have registered, please cancel your registration no later than one business day prior to the event. If you fail to notify AmCham China of your cancellation in a timely fashion, you will forfeit the fee you have already paid.
