The Implementation of PRC’s Tariff Law and Import & Export Compliance for Foreign-invested Enterprises

On April 26, 2024, the Ninth Meeting of the Standing Committee of the Fourteenth National People's Congress adopted the Tariff Law of the People's Republic of China (hereinafter referred to as "Tariff Law"), which would officially come into force on December 1, 2024. Tariffs are taxes levied on imported and exported goods and entry articles, and are collected by the Customs at the import and export stages. On the basis of maintaining the basic stability of existing tariff system, the Tariff Law systematizes and clarifies, in the form of legal provisions, the systems and policies related to tariff collection, which are currently scattered in various laws and regulations, measures and announcements. The Tariff Law systematizes three major technical factors of tariffs, namely, determination of places of origin, commodity classification and dutiable value, and adds new anti-circumvention clauses to enrich the tools of tariff policy and comprehensively improve the tariff collection system. This seminar will discuss more targeted advice to foreign-invested enterprises on import and export compliance in the context of the newly implemented Tariff Law.


2024年4月26日,第十四届全国人民代表大会常务委员会第九次会议通过了《中华人民共和国关税法》,并于2024年12月1日起正式施行。关税是以进出口货物和进境物品为征税对象,由海关在进出口环节征收的税种。在保持现行关税税制基本稳定、税负水平总体不变的基础上,《关税法》将目前散见于各类法规、办法、公告中与关税征收相关制度与政策以法律条文的形式予以体系化释明。《关税法》围绕原产地确定、商品归类与计税价格三大涉税技术要素进行系统化梳理,同时新增反规避条款以充实与完善关税政策工具,全面完善关税征收制度。本次研讨会将着眼于新施行的《关税法》对外资企业进出口合规提供更具针对性的建议。
