This year’s Policy Spotlight on Investment discusses a range of policy uncertainties and operational challenges over the past year, and offers recommendations to strengthen the economic relationship through the ongoing negotiations for the Bilateral Investment Treaty. Published with support from the U.S. Chamber of Commerce, this year’s report provides an update to the 2014 Spotlight on Investment, with a greater focus on implications for the ongoing BIT negotiations.

China is the US’ second largest trading partner and is nearly a $600 billion market for American companies. This year’s investment climate began quite positively with a series of reforms aimed at spurring a more rewarding investment climate for domestic and foreign investment enterprises in China. However, concerns began to mount over a series of draft laws that are negatively impacting the investment climate, and also the US-China Bilateral Investment Treaty negotiations.

The Spotlight includes topics ranging from the overall investment climate, to the recent investment developments in the Asia-Pacific region, SOE reforms, and comments on the recent laws affecting the investment environment in China. The spotlight will offer a comprehensive picture of the current environment for foreign companies, with recommendations to both the Chinese and US governments on ways to improve the investment relationship between the two countries, and finally, to help guide BIT negotiations.

    Mark Duval

    President of American Chamber of Commerce in China

    An American citizen, Mark Duval grew up in Zimbabwe and South Africa and has been based in China since 1996, filling key management positions in the Motorola China organization including corporate strategy, policy and government relations, business development, crisis management, and corporate and go-to-market operations.

    In 2011 Mr. Duval completed the China corporate restructuring and spinoff of Motorola’s Mobility business from Motorola Inc, and is currently leading the transformation of Motorola Mobility’s multibillion dollar go-to-market handset operations in China.

    Mark is an engaged and active leader in the American business community and is currently serving his 5th term on the Board of AmCham China. As chair, co-chair, or board liaison to the AmCham China Public Policy Development Committee, he played an important role supporting the drafting, editing and publication of the annual American Business in China White Paper, from 2006 to 2010.

    Mark has a BSc. from the University of Natal, Durban where he graduated with Deans List honors; a postgraduate diploma in Organizational Psychology from the Australian College of Applied Psychology, and an MBA from the University of Wisconsin-Milwaukee.

    As Vice-Chair of the Board of Governors of the American Chamber of Commerce – People's Republic of China (AmCham) and Chair of its Policy Committee and Insurance Forum, Les Ross is a longstanding leader of the American business and legal communities in China and in frequent contact with government officials and other stakeholders.

    Mr. Ross concentrates his practice on mergers and acquisitions and regulatory matters and has experience in a broad range of industries. He has represented both foreign and local companies and has particular experience advising foreign companies on competition law and regulatory compliance in China.

    Practice

    Mr. Ross represents foreign companies in their strategic expansion in China through direct investments and mergers and acquisitions in industries ranging alphabetically from agriculture to water services. He also has extensive experience representing foreign banks and corporations, including Chinese entities, in their strategic expansion in the United States, particularly focusing on M&A and regulatory clearances and compliance. He has also represented clients in trade, dispute resolution and regulatory matters in China.

    Tim Stratford is managing partner in Covington & Burling LLP’s Beijing office and a member of the International Trade, Corporate and Government Affairs Practice Groups. Mr. Stratford’s practice is focused on advising international clients doing business in China and assisting Chinese companies seeking to expand their businesses globally. As a former Assistant U.S. Trade Representative, Mr. Stratford is the most senior former U.S. trade official working as a member of the U.S. business community in China. Except for the five years he spent in Washington, D.C. in government service (2005-2010), Mr. Stratford has lived and worked continuously in the greater China region since 1982.

    While at USTR, Mr. Stratford was responsible for developing and implementing U.S. trade policy toward mainland China, Taiwan, Hong Kong, Macao and Mongolia. He worked closely with other senior U.S. and Chinese officials from numerous government departments and agencies to address problems encountered by companies engaged in bilateral trade and investment and co-chaired a number of important bilateral working groups and dialogues established under the U.S.-China Joint Commission on Commerce and Trade and the U.S.-China Strategic & Economic Dialogue.

    Prior to serving at USTR, Mr. Stratford was General Counsel for General Motors’ China operations, where he was a member of GM’s senior management team in China and oversaw the company’s legal and trade policy work. Mr. Stratford also served previously as Minister-Counselor for Commercial Affairs at the U.S. Embassy in Beijing and as Chairman of the American Chamber of Commerce in China. He is a graduate of Harvard Law School and Brigham Young University, and is fluent in Mandarin and Cantonese.

    dam is responsible for the overall implementation the European Chamber's objectives, visibility, membership and lobbying activities across its 7 chapters and 9 offices in China (Beijing, Chengdu, Chongqing, Guangzhou, Nanjing, Shanghai, Shenzhen, Shenyang and Tianjin).

    Adam joined the Chamber originally in 2006, serving as the Senior Business Manager and later as the General Manager. Prior to taking the post of Secretary General, he worked for the public affairs firm APCO Worldwide as the deputy Managing Director, Beijing.

    Adam first came to China in 1999 and worked as a commercial officer at the Canadian Embassy. Adam holds dual British and Canadian citizenship, is married and has two children. He holds an M.A.in International Development.
