Under Section 337 of the Tariff Act of 1930 (19 U.S.C. § 1337), the United States International Trade Commission ("Commission") conducts investigations into allegations of certain unfair practices in import trade. Section 337 declares the infringement of certain statutory intellectual property rights and other forms of unfair competition in import trade to be unlawful practices. Most Section 337 investigations involve allegations of patent or registered trademark infringement.
AmCham China Northeast Chapter invites the experts from Jones Day, to introduce the background and concepts of the 337 investigation at the event, outline the investigation procedures and possible response measures that relevant companies can take, share the key and difficult points of resolving trade secret disputes, and provide suggestions on how the company can do a better job in overseas intellectual property layout, risk prevention and control, and dispute resolution on a larger scale.
