Event Details

China’s enforcement of its Anti-Monopoly Law is an important compliance factor for foreign companies doing business in China. The Price Supervision and Anti-Monopoly Bureau of the National Development and Reform Commission (NDRC) is responsible for enforcing China’s antitrust law with respect to price-related anticompetitive conduct, such as price-fixing, resale price maintenance and excessive pricing.

This briefing is in response to questions submitted by AmCham China that addressed specific issues, such as third party distributors (in the situation where the manufacturer is also in the sales market), the NDRC’s treatment of fair, reasonable and non-discriminatory commitments made by standard essential patent holders, market-based assessments of economic and business justifications for resale price maintenance programs, and how (or if) the NDRC include factors like underlying cost-structure or actual investment for R&D to determine the benchmark prices.

Becky Koblitz will moderate this session with officials from NDRC, including the Deputy Director General of the Bureau of Price Supervision and Anti-Monopoly, who will address these questions and more. This is a rare opportunity to learn more about how your China operations could be influenced by this law as it is enforced in China.

    Becky Koblitz is Special Counsel to the Beijing office of Sheppard Mullin, whose 30โ€plus years of legal experience spans three continents and broad areas of expertise. In 1982 Becky began her legal career with the US Department of Justice's Antitrust Division and moved on to corporate law in Berlin, Germany. Since 2008, after relocating to Beijing, China, she has been focusing on antitrust and white-collar investigations in China.

    Given Becky’s unique experience in working with the US Department of Justice, she also advises Chinese companies on US and international antitrust issues as they increasingly invest in the United States and internationally. Becky received her JD from American University Law School and BA and MA from Stanford University. She is admitted to the Washington, D.C. bar. Becky is the author of The Practitioner’s Guide to Antitrust in China, published by Kluwer Law International (2015).
