There have been significant legal developments in the past months around cross-border transfers of personal information and important data outside of China. All organizations with a presence in China must now determine the correct approach and take steps to get compliant by 1 March 2023.


Organizations must first assess โ€“ based on their data processing activities, volume and type of data, operations in China and other factors โ€“ which of the following route is the right one for them to follow:

  • signing standard contractual clauses published by the regulator (Cyberspace Administration of China, "CAC") with each foreign data recipient;
  • passing the CAC organized security assessment and obtaining the approval;
  • obtaining data protection certification issued by professional institutions appointed by the CAC;
  • other mechanisms required by the sectoral authorities.


Once that decision is made, data mapping, repapering of data processing agreements, and engagement with the CAC in one form or another is going to be critical. In this 1-hour webinar, we will discuss the general regulatory regime, the key requirements on cross-border transfer of data, and the implications on organizations with different data processing scales and patterns. We will also recommend compliance actions and identify immediate priorities to assist organizations in planning for the next steps.
