The Medical Security Law of the People's Republic of China was adopted by vote at the 24th Session of the Standing Committee of the 14th National People's Congress on August 28, 2026, and will enter into force on January 1, 2027. As the first foundational and overarching law in China's medical security field, it consists of 7 chapters and 56 articles, marking the maturation and finalization of China's medical security system and serving as an important milestone in advancing the rule of law in China's social security system. This law systematically summarizes the achievements of medical insurance reform in recent years and elevates systems such as centralized volume-based procurement, designated-provider agreement management, fund supervision, and credit management into legal norms, and will have a profound impact on pharmaceutical companies' market access, business operations, and compliance management.

《中华人民共和国医疗保障法》已于2026年8月28日由第十四届全国人民代表大会常务委员会第二十四次会议表决通过，自2027年1月1日起正式施行。作为我国医疗保障领域首部基础性、统领性法律，该法共7章56条，标志着我国医疗保障制度走向成熟定型，是我国社会保障体系建设法治化的重要里程碑事件。这部法律系统总结了近年来医保改革成果，将集中带量采购、定点协议管理、基金监管、信用管理等制度上升为法律规范，对医药企业的市场准入、业务运营和合规管理将产生深远影响。

The newly promulgated Medical Security Law marks the elevation of medical insurance reform achievements into legal norms. The Legal Working Group and the Healthcare Working Group of the American Chamber of Commerce in China (AmCham China) have invited relevant legal experts to systematically interpret the legislative background and regulatory framework, break down key provisions such as the statutory normalization of centralized procurement, designated-provider management, fund supervision, and credit and information protection; analyze, with case studies, legal red lines including illegal use of funds, insurance fraud, violations in centralized procurement bidding, and commercial bribery in procurement and sales; and propose compliance recommendations in three areas—government affairs, legal and compliance, and business operations—to help pharmaceutical companies seize the transition window, improve their compliance systems, and respond to the new stage of law-based medical insurance governance.

《医疗保障法》最新颁布，标志着医保改革成果上升为法律规范。中国美国商会法律工作组联合医疗工作组请来相关法律专家将系统解读立法背景与规制框架，拆解集采法定常态、定点管理、基金监管、信用与信息保护等关键条款；结合案例解析违法使用基金、欺诈骗保、集采投标违规、购销商业贿赂等法律红线；并从政府事务、法务合规、业务运营三方面提出合规建议，助力医药企业把握过渡期窗口、完善合规体系、应对医保法治化新阶段。
