At the recent US-China Strategic and Economic Dialogue, the two countries announced that negotiations on a Bilateral Investment Treaty (BIT) would proceed on the basis of the US Model BIT. These negotiations will present the most significant opportunity to address issues faced by foreign investors in China since China's accession to the WTO in 2001.
Axel Berger, researcher at the German Development Institute, will explain the history of China's negotiation of BITs with other countries, and the evolution of substantive and procedural provisions found in such treaties. Tim Stratford of Covington & Burling will explain the main provisions of the US model BIT and how US companies can help ensure that their concerns are addressed in the course of the ongoing negotiations.
