Interpretation of the Measures for the Environmental Management Registration of New Chemical Substances

On June 11, 2026, the Ministry of Ecology and Environment (MEE) released the Draft Revision to the Measures for the Environmental Management Registration of New Chemical Substances (the "Draft Measures") for public consultation. The proposed revision aims to implement the relevant provisions of the Environmental Code of the People's Republic of China and further improve China's regulatory framework for the environmental management of new chemical substances.

One of the most significant changes in the draft is the removal of the exemption in the current MEE Order No. 12 that excludes pharmaceuticals, pesticides, veterinary drugs, cosmetics, food, food additives, feed, feed additives, fertilizers, and similar products from the scope of the Measures. This revision signals a fundamental shift in the regulatory approachโ€”from regulating based on industry or end use to regulating based on the substance itself. In principle, any substance that is not listed in the Inventory of Existing Chemical Substances in China (IECSC) would be subject to registration requirements, regardless of the industry in which it is used.

For companies operating in the cosmetics, food, agriculture, and other related sectors, raw materials that were previously exempt may now require registration or record-filing as new chemical substances. This change could have significant implications for regulatory compliance costs and market access.
