Roundtable Discussion on the New Trademark Law

On June 26, 2026, the Standing Committee of the National People's Congress (NPC) promulgated a revision of the Trademark Law of the People's Republic of China (2026 TML), which will take effect on January 1, 2027. The review process leading to the current amendment included a draft revision released for public comment by the China National Intellectual Property Administration (CNIPA) in January 2023 (2023 CNIPA Draft), and two deliberation drafts reviewed by the NPC Standing Committee. Although the PRC Trademark Law has been amended four times since its enactment in 1983, the 2026 TML represents the first comprehensive revision since 2013. While the 2026 TML is arguably less ambitious in scope than the controversial 2023 CNIPA Draft, it nevertheless includes some significant and targeted changes that are likely to affect AmCham member companies, including provisions on



i) bad-faith filings

ii) misleading use of registered trademarks

iii) trademark agency regulation

iv) more precise use-based defenses in infringement litigation
